وَإِمَّاAnd eitherأَنْthatيُقَالُit is saidإِنَّthatمُرَادَthe intentionابْنَIbnعَبَّاسٍAbbasرَضِيَmay be pleasedاللَّهُAllahعَنْهُمَاwith both of them
And either it is said that the intention of Ibn Abbas, may Allah be pleased with them, is that
لَاnoتَوْبَةٌrepentanceلَهُfor himفِيْمَاin whatيَتَعَلَّقُis relatedبِحَقٍّto the rightالْمَقْتُولِof the murdered؛;لِأَنَّbecauseالْقَاتِلَthe killerعَمْدًاintentionallyيَتَعَلَّقُis relatedبِهِto himثَلاَثَةَthreeحُقُوقٍrightsحَقٌّthe rightاللَّهِAllahوَحَقٌّand the rightالْمَقْتُولِof the murderedوَالثَّالِثُand the thirdلِأَوْلِيَاءِto the guardiansالْمَقْتُولِof the murdered
there is no repentance for him regarding the rights of the murdered; because the killer intentionally is associated with three rights, the right of Allah, the right of the murdered, and the third to the guardians of the murdered.
أ-A-أَمَّاAs forحَقٌّthe rightاللَّهِ؛of Allah;فَلَاthere is noشَكٌّdoubtأَنْthatالتَّوْبَةَrepentanceتَرْفَعُهُ؛raises it;لِقَوْلِهِfor his sayingتَعَالَى:the Most High:قُلْSay,يَاOعِبَادِيَMy servantsالَّذِينَwhoأَسْرَفُواhave transgressedعَلَىagainstأَنفُسِهِمْthemselvesلَاdo notتَقْنَطُواdespairمِنfromرَّحْمَةِthe mercy ofاللَّهِAllah;إِنَّIndeed,اللَّهَAllahيَغْفِرُforgivesالذُّنُوبَthe sinsجَمِيعًا)all together)
As for the right of Allah; there is no doubt that repentance raises it; for His saying: Say, O My servants who have transgressed against yourselves, do not despair of the mercy of Allah; Indeed, Allah forgives the sins all together.
ب-B-وَأَمَّاAnd as forحَقٌّthe rightأَوْلِيَاءِthe guardiansالْمَقْتُولِ؛of the murdered;فَيَسْقُطُit is droppedإِذَاifسَلَّمَhe surrendersالْإِنْسَانُthe personنَفْسَهُhimselfلَهُمْto themأَتَىcomesإِلَيْهِمto themوَقَالَ:and says:أَنَاIقَتَلْتُ،killed,صَاحِبَكُمْyour companionوَاصْنَعُواand doمَاwhatشِئْتُمْyou want;فَهُمْSo theyإِمَّاeitherأَنْthatيَقْتَصُّواtake retributionأَوْorيَأْخُذُواthey takeالدِّيَةَthe blood moneyأَوْorيَعْفُوا،they pardon,وَالْحَقُّand the rightلَهُمْ.belongs to them.
And as for the right of the guardians of the murdered; it is dropped if the person surrenders himself to them, comes to them and says: 'I killed your companion; and do whatever you want.' So they either take retribution or they take the blood money or they pardon, and the right belongs to them.
ج-C-وَأَمَّاAnd as forحَقٌّthe rightالْمَقْتُولِ؛of the murdered;فَلَاthere is noسَبِيلٌwayإِلَىtoالتَّخَلُّصِget ridمِنْهُfrom itفِيinالدُّنْيَا.the world.
And as for the right of the murdered; there is no way to get rid of it in the world.
وَعَلَىAnd based onهَذَاthisيَحْمِلُit carriesقَوْلَthe sayingابْنِIbnعَبَّاسٍAbbasأَنَّهُthatلَاnoتَوْبَةٌrepentanceلَهُ؛for him;أَيْ:that is:بِالنِّسْبَةِin regardلِحَقِّto the rightالْمَقْتُولِ.of the murdered.
And based on this, it carries the saying of Ibn Abbas that there is no repentance for him; that is: in regard to the right of the murdered.
عَلَىRegardingأَنْthatالَّذِيthe oneيَظْهَرُappearsلِيto meأَنَّهُthatإِذَاifتَابَhe repentsتَوْبَةًrepentanceنَصُوحًا؛sincere;فَإِنَّهُindeedحَتَّىevenحَقٌّthe rightالْمَقْتُولِof the murderedيَسْقُطُ،falls,لَاnotإِهْدَارًاwastingلِحَقِّهِof his rightوَلَكِنَّbutاللَّهَAllahعَزَّ وَجَلَّThe Mighty and Exaltedبِفَضْلِهِby His graceيَتَحَمَّلُbears itعَنْforالْقَاتِلَthe killerوَيُعْطِيand givesالْمَقْتُولَthe murderedرَفْعَةًelevationدَرَجَاتٍranksفِيinالْجَنَّةِthe paradiseأَوْorعَفْوًاpardonعَنfromالسَّيِّئاتِ؛the sins;لِأَنَّbecauseالتَّوْبَةَthe repentanceالْخَالِصَةُthe pureلَاdoes notتَبْقَىleaveشَيْئًا،anything,وَيُؤَيِّدُand supportsهَذَاthisعُمُومُthe generalityآيَةٌverseالْفُرْقَانِ:of Al-Furqan:﴿﴿وَالَّذِينَAnd those whoلَاdo notيَدْعُونَinvokeمَعَwithاللَّهِAllahإِلَىٰanotherإِلَٰهِgod;وَلَاand norيَقْتُلُونَthey killالنَّفْسَthe soulالَّتِيthe one whichحَرَّمَhas forbiddenاللَّهُAllahإِلَّاexceptبِالْحَقِّin justice......إِلَىuntilقَوْلِهِ:His saying:﴿﴿إِلَّاexceptمَنwhoتَابَrepentsوَآمَنَand believesوَعَمِلَand doesعَمَلًاan actصَالِحًا؛righteous;فَأُوْلَئِكَthose areيُبَدِّلُHe exchangesاللَّهُAllahسَيِّئَاتِهِمْtheir sinsحَسَنَاتٍ﴾good deeds﴾
And supports this the generality of the verse of Al-Furqan: And those who do not invoke with Allah another god; and do not kill the soul which Allah has forbidden except in justice... until His saying: Except for the one who repents and believes and does a righteous act; for those Allah exchanges their bad deeds for good deeds﴾.
وَفِيAnd inهَذِهِthisالْآيَةِverseمِنofصِفَاتِattributesاللَّهِAllahالْغَضَبِ،the anger,وَاللَّعْنِand the curseوَإِعَدَادِand the preparation٢٦٨268
And in this verse are attributes of Allah, anger, and the curse and preparation.
