فَإِنَّSo ifقَصَدَintendedالتَّعْلِيقَthe suspensionبِالمَشِيئَةِwith the willفِيinالحَالِthe presentكَانَit wasمُخْطِئًاmistakenبِالِاتِّفَاقِby consensus

So if the intention is to suspend it in the present, he is mistaken by consensus.

وَإِنْAnd ifقَصَدَhe intendsالتَّعْلِيقَthe suspensionفِيinالمُسْتَقْبَلِthe futureلَاis notيَكُونَto beمُخْطِئًاmistaken

And if he intends the suspension in the future, he is not mistaken.

بِالِاتِّفَاقِby consensus

by consensus.

فَصْلٌSection

Section

قَالَHe saidالمُصَنِّفُthe authorأَبُوAbuحَنِيفَةَHanifaرَضِيَ اللهُ عَنْهُmay Allah be pleased with him::(وَالْعَاصُونَ(And the disobedientمِنَofاللهِAllahأُمَّةِthe nationمُحَمَّدٍMuhammadاللهِAllahكُلُّهُمْall of themمُؤْمِنُونَare believersوَلَيْسُواand they are notبِكَافِرِينَdisbelievers)

The author Abu Hanifa, may Allah be pleased with him, said: (And the disobedient of Allah, the nation of Muhammad, all of them are believers and are not disbelievers).

أَقُولُI say::إِنَّIndeedالْعَبْدَthe servantالْمُؤْمِنَthe believerلَاnotيَكُونَto beكَافِرًاa disbelieverبِالْفِسْقِby sinوَالمَعْصِيَةِand disobedienceلَأَنَّbecauseالإِيمَانَfaithإِقْرَارٌis acknowledgmentوَتَصْدِيقٌand confirmationوَالْإِقْرَارُand the acknowledgmentوَالتَّصْدِيقُand the confirmationبَاقٍremainsفَيَكُونُthus the faith remainsالإِيمَانُfaithبَاقِيًاremainingإِلَّاunlessأَنْthatتَكُونَit isالمَعْصِيَةُthe disobedienceمُوجِبَةًobligatingلِلْكُفْرِto disbeliefفَيَكُونُthen it becomesالإِيمَانُfaithزَائِلًاabsentلَأَنَّbecauseالكُفْرَdisbeliefيَزِيلُremovesالإِيمَانَthe faith

I say: Indeed, the believer servant does not become a disbeliever by sin and disobedience because faith is acknowledgment and confirmation, and acknowledgment and confirmation remain; thus faith remains unless the disobedience obligates disbelief, then faith becomes absent because disbelief removes faith, as previously mentioned.

وَAndفَصْلٌsectionقَالَHe saidالمُصَنِّفُthe authorأَبُوAbuحَنِيفَةَHanifaرَضِيَ اللهُ عَنْهُmay Allah be pleased with him::(الْعَمَلُ(Actionغَيْرُis notالإِيمَانِthe faithوَالْإِيمَانُand faithغَيْرُis notالْعَمَلُthe actionأَقُولُI sayهَذَاthisعِندَaccording toأَهْلِthe peopleالْحَقِّof the truth33اللهُAllahتَعَالَىthe Exaltedخِلَافًاcontrary toلِلْخَوَارِجِthe KhawarijقَالَHe saidإِبْنُIbnحَجَرٍHajarالْهَيْثَمِيُّAl-HaythamiفِيinشَرْحِexplanationالأَرْبَعِينَThe Fortiesالنَّوَوِيَّةِthe Navawi::الإِيمَانُFaithهُوَisلُغَةًLinguisticallyالتَّصْدِيقُconfirmationوَشُرُوطُand conditionالتَّصْدِيقِof the confirmationبِالْقَلْبِby the heartفَقَطُonlyإِلَىuntilأَنْthatقَالَhe saidوَقِيلَand it is saidيُشْتَرَطُit is conditionedأَنْthatيَضُمَّit combinesإِلَىtoذَاكَthatإِقْرَارًاacknowledgmentبِاللِّسَانِby the tongueوَعَمَلًاand actionبِسَائِرِwith allالْجَوَارِحِthe limbsفَيَكْفُرُthen he disbelieves

And the author Abu Hanifa, may Allah be pleased with him, said: (Action is not faith, and faith is not action. I say, this is according to the people of truth regarding Allah, the Exalted, contrary to the Khawarij. Ibn Hajar Al-Haythami said in the explanation of the Forty Nawawi: Faith is linguistically confirmation, and the condition for confirmation is only in the heart until he said: And it is said that it is required to be combined with that acknowledgment by the tongue and action with all the limbs, thus he disbelieves from it.)
